These Terms govern the use of Axario, operated by Praxis Marketing Consultancy (Pty) Ltd. By accessing or using Axario, you agree to these Terms and our Privacy Policy.
Service description
Axario is a software-as-a-service platform providing asset management tools, compliance tracking systems, maintenance scheduling, operational reporting and contractor task management. Axario is a software tool only and does not provide professional services.
No professional advice
Axario does NOT provide legal advice, engineering advice, regulatory compliance advice, safety certification, or audit services. Axario is not a certifying body, auditor, inspector, or regulatory authority. All information is provided for operational support only.
No reliance on outputs
Users must not rely on Axario outputs, templates, reports, or recommendations as a substitute for professional certification, legal compliance verification, engineering inspection, or regulatory approval. Axario outputs are informational and operational support tools only.
User responsibilities
- Ensuring compliance with applicable laws, regulations, and industry standards
- Verifying accuracy of all data entered and all outputs before relying on them
- Seeking professional advice where required
- Proper use of the platform
Users and organisations are solely responsible for ensuring compliance. Axario does not validate, certify, or guarantee compliance outcomes.
No guarantee of compliance
Axario does not guarantee regulatory compliance, audit success, certification approval, or legal/statutory compliance. Compliance remains the responsibility of the user organisation.
Intellectual property
Praxis Marketing Consultancy (Pty) Ltd retains all right, title and interest in and to the Axario platform, including its software, source code, design, branding, trademarks and documentation. Subscribing to Axario grants you a limited, non-exclusive, non-transferable right to use the platform within your chosen plan. You may not copy, resell, redistribute, reverse engineer or circumvent the technical limits of the platform. You retain ownership of the content and data you upload.
Subscriptions, pricing & billing
Access to paid features is provided on a subscription basis. Plans and pricing are shown on our pricing page and at the point of purchase. Subscriptions are billed in advance on a recurring monthly cycle in the currency displayed (ZAR for South Africa, USD internationally) and renew automatically until cancelled. Prices exclude VAT where applicable. We may change pricing on reasonable notice; changes take effect from your next billing cycle.
A free trial may be offered to new organisations. Unless you subscribe before the trial ends, paid features become unavailable when the trial expires. You can cancel your subscription at any time from your workspace billing settings; cancellation stops future renewals and access continues until the end of the current paid period.
Payment processing
Subscription payments are processed securely by our payment providers. South African (ZAR) payments are processed by Paystack (a Stripe company); by subscribing you also agree to Paystack's applicable terms. Axario does not store your full payment card details.
Our order process for international payments is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for those orders, meaning Paddle is the seller of record responsible for processing the payment, billing, invoicing, and handling returns. Paddle also provides related customer service inquiries. International purchases are additionally subject to Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms.
Refunds and cancellations are handled in accordance with our Refund Policy.
Organisation model
Each organisation operates as an isolated tenant. Organisation boundaries are strictly enforced and data is not shared across organisations.
Service Provider & Contractor model
Service Provider is an organisational operating model for managing client portfolios within a single organisation. Contractor is an invited user performing assigned tasks only. Contractors do not have administrative or portfolio management rights.
Dual Perspective
Dual Perspective is a view/filter system only and does not change permissions or data access boundaries.
User content & uploaded documents
Users retain ownership of their uploaded content and grant Axario a licence to store, process and display content for operational purposes.
Users are fully responsible for all uploaded content (certificates, reports, photos, contracts and documents). Axario does not verify, validate, or certify uploaded documents. Uploaded content does not constitute legal or regulatory compliance proof — Axario is a storage and workflow system only.
Prohibited use
- Attempting to breach system security
- Accessing other organisations’ data
- Misusing the platform for unlawful purposes
Indemnity
Users agree to indemnify and hold harmless Praxis Marketing Consultancy (Pty) Ltd and Axario against any claims, damages, losses, penalties, or legal actions arising from their use of the platform, reliance on its outputs, uploaded content, or compliance failures.
Limitation of liability
To the maximum extent permitted by law, Axario is not liable for compliance failures, regulatory penalties, financial losses, business interruption, or indirect damages.
Termination
We may suspend or terminate access for material breach of these Terms, non-payment of subscription fees, security or fraud risk, or repeated or serious policy violations.
Governing law
These Terms are governed by the laws of the Republic of South Africa. Where users operate in other jurisdictions, local mandatory laws may also apply.
